Terms of Service

These terms apply to www.capablhq.com (the "website") and the Capabl platform (the "platform"), provided by 3DOMCommerce OÜ, registry code 17011396, Järvevana tee 9, 11314 Tallinn, Estonia ("Capabl", "we", "us"). By using them you accept these terms. If your company has signed a separate agreement with us, that agreement takes precedence.

1. The service

Capabl audits product pages and catalogues, identifies gaps in AI and search visibility, and generates content to close them. Features may change as the product develops.

2. Accounts

Platform access is for businesses. You must give accurate information, keep your sign-in details secure, and make sure that everyone who uses your company's account is authorised to do so.

3. Connected services

You may connect third-party services such as Google Merchant Center. You confirm that you are authorised to connect them, and you authorise Capabl to read data from them and to submit content you approve to them. Their own terms continue to apply to your use of them. You can disconnect them at any time.

4. Your content

You keep all rights to the data and content you provide. You grant Capabl the rights needed to process it to provide the service. Content Capabl generates for you is yours to use once delivered. You are responsible for reviewing generated content before you publish it.

5. Acceptable use

• Do not break the law or infringe others' rights through the service.
• Do not attempt to access data or systems you are not authorised to use.
• Do not disrupt, overload or reverse-engineer the service.

6. Fees

Paid plans are governed by the order or agreement your company signs with us.

7. Privacy

Our Privacy Policy explains how we handle personal data, including data received from Google APIs.

8. Disclaimers and liability

The service is provided "as is". We do not guarantee specific search rankings, traffic or revenue results. To the extent permitted by law, Capabl is not liable for indirect or consequential losses, and our total liability is limited to the fees your company paid us in the 12 months before the claim.

9. Termination

You can stop using the service at any time. We may suspend or end access if these terms are breached. On termination we handle your data as described in the Privacy Policy.

10. Changes

We may update these terms and will post the new version on this page with a new date. Significant changes will be notified to platform users in advance.

11. Governing law

These terms are governed by the law of Estonia, and disputes are subject to the jurisdiction of the courts of Estonia.
